Risk during shipping (consumers): When you buy as a consumer, the risk of loss of or damage to the goods only passes to you once you, or a third party nominated by you, have physically received the goods. This does not apply if you chose a carrier yourself that we did not offer.

If an item arrives damaged or is lost in transit, please contact us as soon as possible so that we can find a solution.

belongs to Okunique or our licensors and is protected by copyright and other intellectual property laws.

By using our services, you acknowledge that Shopify is not a party to the transactions between you and Okunique. Okunique is and remains the responsible contracting party for all purchases made through the online store, and your statutory consumer rights can always be enforced against Okunique.

15. Your consumer rights and complaints

Customers in the United Kingdom: Under the Consumer Contracts Regulations 2013, you have the right to cancel your order within 14 days of receiving the goods. Under the Consumer Rights Act 2015, goods must be as described, of satisfactory quality and fit for purpose. If they are faulty, you are entitled to reject them for a full refund within 30 days of delivery. After that, you are entitled to a repair or replacement, or, if that is not possible, a price reduction or refund.

Customers in Denmark and the EU: Under the Danish Sale of Goods Act, you generally have a 24-month right to complain about defects in goods bought in our online store that were present at the time of delivery. Under the Danish Consumer Contracts Act, you also have a 14-day right of withdrawal from the day you receive the goods.

If we cannot reach an agreement, consumers in the United Kingdom can obtain free advice from the Citizens Advice consumer service (www.citizensadvice.org.uk), and consumers in Denmark can file a complaint with the Danish Consumer Complaints Board (Forbrugerklagenævnet) via www.naevneneshus.dk.

Exception for consumers: This limitation of liability does not apply:

• in cases of intent or gross negligence on our part
• to death or personal injury
• to our liability under mandatory consumer protection law, including product liability law
• in any other case where liability cannot be excluded towards consumers

18. Indemnification

If you use our services in breach of these terms or applicable law, you agree to indemnify Okunique and our partners, directors, employees and suppliers against reasonable claims, losses or damages, including reasonable legal costs, arising directly from:

• your material breach of these terms of service
• your breach of applicable law
• the infringement of third-party rights through your use of our services

This provision does not apply to normal use of the online store as a consumer and does not limit your statutory rights.

If such a claim arises, we will inform you as soon as possible. You agree to cooperate in handling such claims.

19. Severability

If any provision of these terms of service is found to be unlawful, invalid or unenforceable, that provision will be limited or removed to the extent necessary.

The remaining provisions will remain valid and enforceable.

20. Waiver and entire agreement

If we fail to enforce any provision of these terms, this does not mean that we waive our rights.

These terms of service, together with our policies, form the entire agreement between you and Okunique regarding the use of our services and replace all previous agreements or understandings.

21. Assignment

You may not assign or transfer your rights or obligations under these terms without our written permission.

We may assign or transfer our rights and obligations without prior consent, provided that your rights as a consumer are not reduced as a result.

22. Governing law and jurisdiction

These terms of service are governed by Dutch law, as Okunique is operated by RvB Online FSMB, which is registered in the Netherlands.

Consumers: If you are a consumer living in the United Kingdom, Denmark or another EU country, you will always benefit from the protection of the mandatory rules of the law of your country of residence. You can also always bring a claim or file a complaint before the courts or consumer complaints body in your country of residence.

The headings in these terms of service are included for convenience only and have no legal effect on the interpretation of the terms.

The latest version of these terms of service will always be available on this page.

We reserve the right to update or change these terms as needed. Material changes will be communicated by email or by a clear notice on the website.

It is your responsibility to review the terms regularly for changes.

Your continued use of our services after changes have been published means that you accept the updated terms, to the extent that the changes are reasonable and do not limit rights you have already acquired.
